Use of the Site

You may use the Site to learn about our program, see our class schedule, sign up, donate through PayPal and contact us. The Site sells nothing and takes no payments. You agree to use it lawfully, and not in any way that could damage, disable or overburden it, or interfere with anyone else’s use of it.

Prohibited conduct

When using the Site, you agree that you will not:

• Misuse the sign-up formSubmit false, misleading or spam content, or sign up as someone you are not.
• Scrape or harvestUse automated tools to copy or collect content or data from the Site without our written permission.
• Bypass securityProbe, attack or try to get around any security measure on the Site.
• Infringe rightsUse the Site to infringe anyone’s intellectual property, privacy or other rights.

Signing up

When you sign up or contact us, you confirm that what you send is accurate and yours to share. If you sign up someone under 18, you confirm that you are their parent or legal guardian, or have their permission. The sign-up form and the class schedule are Gymdesk’s, so Gymdesk’s terms also apply to what you enter there. We use what you send as our Privacy Policy describes.

Intellectual property

The Site’s content, including the Fighting Chance name, logo, photographs, video, text and design, belongs to Fighting Chance or those who license it to us. You may view the Site and share links to it. You may not copy, change or republish its content without our written permission, except as the law allows.

No medical or fitness advice

Information on the Site about our program, training and conditioning is general information, not medical or professional advice. Combat sports and fitness training carry risks. Speak to a doctor before starting any new exercise program, especially if you have a medical condition or are recovering from an injury.

Other services and links

Parts of the Site come from other companies, and some links lead to their websites. Each is governed by its own terms and privacy policy, and we are not responsible for their content or practices:

Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent the law allows, Fighting Chance disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy. We do not promise that the Site will always be available, free of errors or secure, or that its information is always complete and current.

Limitation of liability

To the fullest extent the law allows, Fighting Chance and its directors, staff, volunteers and contractors will not be liable for any indirect, incidental, consequential, special or punitive damages arising from your use of the Site. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars ($100). This does not limit any liability that the law does not allow us to limit, and does not affect the separate forms or waivers that apply to taking part in our program.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute about these Terms or the Site will be resolved in the state or federal courts in Los Angeles County, California, and you consent to those courts’ jurisdiction.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Using the Site after a change takes effect means you accept the revised Terms.
